Commissioner congratulates Immigration Minister on Moeller decision
Human Rights Commissioner, Graeme Innes today congratulated Immigration Minister, Chris Evans on the way he has dealt with the Moeller case.
Dr Moeller, practising in Horsham, Victoria, and his family were recently refused permanent Australian residency due to his son having Downes syndrome.
"In coming to his decision to grant permanent residency to the Moeller family, Minister Evans made three decisions that highlighted his sensitivity to disability and discrimination issues," Commissioner Innes said.
"Firstly, he granted permanent residence to the Moeller family, recognising the positive contribution which Dr Moeller and his son Lucas could make to the Australian community - he didn't just think about the negatives of disability," Commissioner Innes said.
"Secondly, he made the decision quickly, removing further stress on the family.
"And thirdly, he indicated a willingness to address the broader policy question of how such discriminatory decisions are made.
"Current regulations encourage a focus only on negative issues regarding disability. What I hope we will achieve is more balanced decision-making," Commissioner Innes said.
Commissioner Innes said the decision was an excellent result for the Moeller family and a very promising step forward for people with disabilities.
