Exemptions
HREOC is able to grant temporary exemptions from some parts of the Sex Discrimination Act, the Disability Discrimination Act and the Age Discrimination Act.
Exemptions can only be granted for purposes that further the objects of the respective Act. They may be subject to conditions set out by the HREOC and are provided for a term of no more than five years.
HREOC seeks to make decisions in an accountable manner and generally seeks public comment on exemption applications before making a decision. We have developed criteria and procedures to provide guidance in determining when a temporary exemption should be granted. By publishing these criteria we hope to assist interested parties to have an effective say about how decisions on possible exemptions may affect them.
