Notice of application for temporary exemption
The Australian Human Rights Commission has received an application from Auto & General Insurance Company Limited, A & G Insurance Services Limited, Australian Insurance Holdings Pty Ltd, and their employees, agents, insurance distributors and contractors.
This application is made pursuant to s 44 of the Sex Discrimination Act 1984 (Cth) and is for an exemption from the operation of ss 22(1)(b), 22 (1)(c) and 27 of the Act.
The applicants request the exemption to allow them to price their policies differentially based on a customer’s marital status, according to actuarial data about the relative claims risk associated with different marital status.
The exemption is sought for five years.

Request for Submissions
The Australian Human Rights Commission is presently considering this exemption application, and invites interested parties to make submissions, preferably by email to legal@humanrights.gov.au.
Submissions may also be addressed by mail to the Legal Services Unit, Australian Human Rights Commission, GPO Box 5218, Sydney NSW 2001.
Submissions must be received before 18 December 2009. Submissions received after this date will not be considered.
To promote open public discussion and exchange of views, the Australian Human Rights Commission intends to post submissions made electronically on its Internet site. Any requests for material to be treated as confidential should be clearly indicated.
